Unibet Faces Challenges with Dutch Regulator KSA
FDJ United’s renowned Unibet brand, known as Optdeck in the Netherlands, recently encountered issues with the country’s gambling regulator, the Kansspelautoriteit (KSA). The company received two official warnings for violating strict Dutch regulations aimed at minimizing gambling harm.
Unlawful Advertising on Buses
The initial warning was related to untargeted advertising, a practice banned in the Netherlands since 2023. Despite an agreement that Unibet’s logo should only appear on the bus used by the Unibet Tietema Rockets cycling team, the branded bus was utilized for other purposes, leading to a breach of the agreement and advertising guidelines.
In response, the KSA demanded the cycling team to discontinue using the bus immediately and replace the Unibet logo with modified stickers on the bus and team vehicles. The regulator emphasized that providers are responsible for ensuring sponsorship agreements comply with laws and regulations, stating that the current bus configuration will be prohibited from July 1, 2025, coinciding with the ban on sports sponsorship.
Optdeck clarified that managing multiple sponsorship deals can be challenging, and they were unaware of the bus’s unauthorized use for transportation activities.
Autoplay Function Error
The second warning stemmed from Unibet’s BonusBuy feature including an autoplay function, allowing players to continue playing automatically after purchasing bonuses. This feature is strictly prohibited by Dutch law for online gambling products targeting Dutch players.
Optdeck explained that a third-party unintentionally activated the function shortly after launch, which was promptly disabled after being live for two hours. The company reimbursed players who incurred losses during this period and is implementing measures to prevent such incidents in the future.
The KSA acknowledged that both violations ceased promptly upon detection, resulting in a warning for now. However, the regulator cautioned that any future infractions could result in more severe penalties.
Regulatory Measures to Reduce Gambling Harm
The Netherlands has taken significant steps to minimize gambling harm, including the ban on untargeted gambling advertisements across various media platforms since July 2023. Only highly targeted ads meeting strict criteria are permitted.
Additionally, the KSA introduced mandatory deposit limits and verification checks to ensure players can afford their gambling activities. These initiatives have effectively reduced the number of individuals losing over €1,000 ($1,177) monthly from 4% to approximately 1.2%.
Player protection remains a top priority in Dutch gambling policy as the country continues to enforce stringent regulations to safeguard individuals from the adverse effects of gambling.
