Underdog Fantasy Settles $17.5 Million Agreement with NYSGC
Daily Fantasy Sports (DFS) operator Underdog Fantasy has reached a settlement of $17.5 million with the New York State Gaming Commission (NYSGC). The agreement comes after allegations of unlawful operations, leading the operator to withdraw its drafts and pick’em games from the state market. However, despite this setback, Underdog Fantasy is determined to make a comeback in the Empire State by applying for a permanent license.
The Company’s Cooperation
The settlement, announced on Friday, follows an investigation by the NYSGC, which revealed that Underdog utilized its temporarily licensed subsidiary, Synkt, to offer DFS contests that were not allowed under New York law. The company, while maintaining its innocence and disputing the regulator’s interpretation of the statutes, decided to settle the matter by ceasing its offerings and paying the fine to avoid a prolonged legal battle.
NYSGC Commission chair Brian O’Dwyer emphasized the importance of playing through permitted operators to ensure compliance with comprehensive regulations that safeguard New Yorkers.
Underdog Fantasy’s general counsel, Nicholas Green, defended the company’s stance by highlighting the regulatory uncertainties that have surrounded New York’s DFS industry for nearly a decade. Green clarified that the issue was related to licensing rules rather than the specific game offerings and expressed optimism about reinstating all contests for New Yorkers.
Underdog’s Expansion Strategy
Despite the temporary withdrawal from New York, Underdog has already taken steps to relaunch its operations by applying for a permanent fantasy sports license in the state. The company’s cooperation with the regulator is expected to boost its chances of resuming operations in one of its key markets.
New York’s complex DFS regulatory landscape favors legacy operators like DraftKings and FanDuel, creating challenges for newer entrants. Underdog’s decision to expand its offerings in New Jersey and Delaware with the Pick’em Champions product demonstrates the company’s commitment to growth while adhering to local regulations.
Furthermore, Underdog has adapted its business model across different states to comply with varying regulatory frameworks. In 16 states, the company offers a peer-to-peer version of its games under the Champions brand, enabling it to navigate the evolving US regulatory environment effectively.
